Cherokee Judicial Circuit Judge Suzanne H. Smith set bond at $300,000 for a Euharlee man facing murder charges in connection with an Oct. 24 shooting in Bartow Superior Court Monday morning.
Bartow County Sheriff’s Office (BCSO) data indicates defendant Cody Lamont Daniell, 45, is also facing one count of aggravated assault and one misdemeanor count of willful obstruction of law enforcement officers.
“This is going to be a case where the defense is going to be self-defense,” said Daniell’s attorney Lance McCoy. “In my opinion, it is a very good self-defense case.”
31-year-old Jonathan Andrew Smith was shot and killed at Daniell’s residence off Milam Bridge Road last month.
Cherokee Judicial Circuit Assistant District Attorney Whitney Law said a Euharlee Police Department investigation is ongoing.
“Our understanding is that Mr. Daniell and his wife were at their home, they had Jonathan Smith, who is the deceased victim in this case, they had him and his wife present at their home, ” Law told the court. “The two couples had gone to a winery out in Acworth … at some point in time, both of the males ended up outside of the home and there was a gunshot that took place.”

Law said the State believes that alcohol may have been a factor in the shooting.
“It’s our understanding that all parties were drinking that night,” she said. “Mr. Daniell … he does have DUI history, one he pled nolo to, the other was reduced to a reckless, so we’re seeing a pattern of alcohol as contributing to something in Mr. Daniell’s life.”
McCoy alleged that Smith began choking the defendant and said “he was going to kill him.”

At that point, McCoy claimed his client discharged a firearm, from point-blank range, in self-defense.
Without mentioning any specific details, Law responded by telling the court “there are some facts that make this not a self-defense case, obviously.”
The spouses of both the victim and the defendant — Dessie Lauren Daniell and Kelsey Michelle Smith — were also arrested at the residence on misdemeanor obstruction charges.
Law said the State had concerns about granting the defendant bond, citing the number of firearms found at his residence.
“One of them was an AK-type weapon that was found in Mr. Daniell’s personal vehicle, there were three guns alone that were found on top of the refrigerator in the kitchen,” she said. “The information law enforcement provided was that they seized approximately 8,000 rounds of ammunition from this location.”
McCoy said the defendant, at the time of the shooting, worked for the United States Army Corps of Engineers. Neither the prosecution or the defense noted that Daniell is also an attorney, who has been a member of the State Bar of Georgia since 2016.
Nor did Law or McCoy note that Smith was the president of the Cartersville-based general contractor firm JA Smith and Co., LLC.

“These are without a doubt, both sides agree, serious charges that are pending here,” Judge Smith said. “He’s 45 years old with no prior felonies, he was honorably discharged as a veteran, was employed has connections to the community — he hits all the checkmarks, in that regard, for a candidate to be considered for bond.”
If released from pretrial custody, the defendant is not allowed to reside in a home with firearms nor personally possess any firearms or ammunition.
Judge Smith also barred the defendant from possessing or consuming alcohol while on bond, additionally ordering the defendant to remain in the state of Georgia unless he receives prior permission from the court.
The defendant is also ordered to have no contact with the victim’s family or any witnesses in the case, except for his spouse.
Law said she expects the district attorney’s office to expedite the case for indictment.
“Given the seriousness of the case, given the fact that we now have grand juries, we would make it a priority, obviously, as soon as we could,” she said.
BCSO records indicate Daniell was released from pre-custody detention shortly before noon on Nov. 3.
Cartersville woman dies after falling 300 feet from Mount Yonah in north Georgia

A 46-year-old Cartersville woman fell 300 feet to her death from Yonah Mountain in White County late Tuesday morning, authorities said.

White County Emergency Services responded to the rock face formation of Yonah Mountain on Tuesday morning at about 10:30 a.m., after receiving reports of a woman falling from the rock face, according to White County Public Safety Director David Murphy.

Murphy said that deputies from the White County Sheriff's Office, along with crews from White County Fire Service and EMS, with mutual aid from the Helen Fire Department and Lee Arrendale Fire Brigade, responded to the incident.

EMS and Fire crews had to use a rope system to access the woman, who Murphy said was declared dead at the scene.

She was later identified as 46-year-old Jennifer Randal of Cartersville, Murphy said. Randal was hiking with her husband and son when she fell more than 300 feet from the rock face.

The family was familiar with the area and had hiked there several times before, Murphy said.

He said that it took several hours to recover Randal's body from where it had fallen.

'This is of those tragic accidents that can occur while hiking in the trail areas of our county,' Murphy said in a release.

County officials said there did not appear to be any foul play involved, however, according to Murphy, the White County Sheriff's Office and the Georgia Department of Natural Resources are continuing to investigate the incident.
